Public authorities which may have access to personal data in the context of an individual investigation in accordance with Union or Member State law are not recipients; the processing of those data by within the Union and the latter place of activity is competent to implement those decisions, the place of activity which took those decisions shall be considered the centre of activity; (b) in the case of a processor having its place of business in more than one Member State, the place of its central administration within the Union or, where the processor does not have a central administration in the Union, the place of business of the processor within the Union where the main processing activities in relation to the activities carried out at the place of business of the processor take place, where the processor is subject to obligations under this Regulation;<\/li><li class=\"whitespace-normal break-words\"><strong>\"representative\"<\/strong>: a natural or legal person established or resident in the Union and designated in writing by the controller or processor pursuant to Article 27 to represent the controller or processor in relation to the obligations incumbent on the controller or processor under this Regulation;<\/li><li class=\"whitespace-normal break-words\"><strong>\"enterprise\"<\/strong>: any natural or legal person carrying on an economic activity, regardless of its legal form, including partnerships and associations carrying on a regular economic activity;<\/li><li class=\"whitespace-normal break-words\"><strong>\"group of undertakings\"<\/strong>: the controlling undertaking and the undertakings it controls;<\/li><li class=\"whitespace-normal break-words\"><strong>\"binding corporate rules\"<\/strong>: the rules on the protection of personal data followed by a controller or processor established in the territory of a Member State of the Union in one or more third countries in respect of a transfer or series of transfers of personal data by a controller or processor within the same group of undertakings or the same group of undertakings engaged in a joint economic activity;<\/li><li class=\"whitespace-normal break-words\"><strong>\"supervisory authority\"<\/strong>: an independent public authority established by a Member State in accordance with Article 51;<\/li><li class=\"whitespace-normal break-words\"><strong>\"supervisory authority concerned\"<\/strong>: the supervisory authority concerned by the processing of personal data on the basis of one of the following grounds: a) the controller or processor has an establishment in the territory of the Member State of that supervisory authority; b) the processing significantly affects or is likely to significantly affect data subjects residing in the Member State of the supervisory authority; or c) a complaint has been lodged with that supervisory authority;<\/li><li class=\"whitespace-normal break-words\"><strong>\"cross-border processing of personal data\"<\/strong>(a) processing of personal data within the Union which takes place in the context of activities carried out by a controller or processor established in more than one Member State in several places of activity in several Member States; or (b) processing of personal data within the Union which takes place in the context of activities carried out by a controller or processor in a single place of activity and which significantly affects or is likely to significantly affect data subjects in more than one Member decision to the fundamental rights and freedoms of data subjects and, where applicable, to the free flow of personal data within the Union;<\/li><li class=\"whitespace-normal break-words\"><strong>\"information society services\"<\/strong>: service within the meaning of Article 1(1)(b) of Directive (EU) 2015\/1535 of the European Parliament and of the Council ( 1 );<\/li><li class=\"whitespace-normal break-words\"><strong>\"international organization\"<\/strong>: an organisation governed by public international law, or its subsidiary organs, or any other body which is established by or under an agreement between two or more countries.<\/li><\/ol><h5 class=\"text-xl font-bold text-text-100 mt-1 -mb-0.5\">Legal basis for processing<\/h5><p class=\"whitespace-normal break-words\">(Act CXII of 2011 on the Right to Informational Self-Determination and Freedom of Information, \u00a7 5)<\/p><ol class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-decimal space-y-1.5 pl-7\"><li class=\"whitespace-normal break-words\">Personal data may be processed if<\/li><\/ol><p class=\"whitespace-normal break-words\">(a) it is ordered by law or, on the basis of an authorisation granted by law and within the scope specified therein, by an ordinance of a local authority for a purpose in the public interest in the case of data which are not special categories of data or personal data relating to criminal matters,<\/p><p class=\"whitespace-normal break-words\">(b) in the absence of point (a), it is strictly necessary for the performance of the controller's tasks laid down by law and the data subject has given his or her explicit consent to the processing of the personal data,<\/p><p class=\"whitespace-normal break-words\">(c) except as provided for in point (a), necessary and proportionate for the protection of the vital interests of the data subject or of another person, or for the prevention or elimination of an imminent threat to the life, limb or property of a person; or<\/p><p class=\"whitespace-normal break-words\">(d) in the absence of point (a), the personal data have been explicitly disclosed by the data subject and the disclosure is necessary and proportionate for the purpose of the processing.<\/p><h5 class=\"text-xl font-bold text-text-100 mt-1 -mb-0.5\">Lawfulness of processing<\/h5><p class=\"whitespace-normal break-words\">(REGULATION (EU) No 2016\/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95\/46\/EC (General Data Protection Regulation), Article 6)<\/p><p class=\"whitespace-normal break-words\">The processing of personal data is lawful only if and to the extent that at least one of the following conditions is met:<\/p><p class=\"whitespace-normal break-words\">a) the data subject has given his or her consent to the processing of his or her personal data for one or more specific purposes;<\/p><p class=\"whitespace-normal break-words\">(b) the processing is necessary for the performance of a contract to which the data subject is a party or for taking steps at the request of the data subject prior to entering into the contract;<\/p><p class=\"whitespace-normal break-words\">(c) processing is necessary for compliance with a legal obligation to which the controller is subject;<\/p><p class=\"whitespace-normal break-words\">(d) processing is necessary for the protection of the vital interests of the data subject or of another natural person;<\/p><p class=\"whitespace-normal break-words\">(e) processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;<\/p><p class=\"whitespace-normal break-words\">(f) processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where those interests are overridden by the interests or fundamental rights and freedoms of the data subject which require the protection of personal data, in particular where the data subject is a child.<\/p><p class=\"whitespace-normal break-words\">Point (f) of the first subparagraph shall not apply to the processing of data by public authorities in the exercise of their functions.<\/p><h5 class=\"text-xl font-bold text-text-100 mt-1 -mb-0.5\">Principles governing the processing of personal data<\/h5><p class=\"whitespace-normal break-words\">(REGULATION (EU) No 2016\/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95\/46\/EC (General Data Protection Regulation), Article 5)<\/p><h5 class=\"text-lg font-bold text-text-100 mt-1 -mb-1.5\">(1) Personal data:<\/h5><p class=\"whitespace-normal break-words\">(a) be processed lawfully and fairly and in a transparent manner for the data subject (\"lawfulness, fairness and transparency\");<\/p><p class=\"whitespace-normal break-words\">(b) be collected only for specified, explicit and legitimate purposes and not processed in a way incompatible with those purposes; further processing for archiving purposes in the public interest, scientific and historical research purposes or statistical purposes shall not be considered incompatible with the original purpose in accordance with Article 89(1) ('purpose limitation');<\/p><p class=\"whitespace-normal break-words\">(c) be adequate, relevant and limited to what is necessary for the purposes for which the data are processed (\"data minimisation\");<\/p><p class=\"whitespace-normal break-words\">(d) be accurate and, where necessary, kept up to date; all reasonable steps must be taken to ensure that personal data which are inaccurate for the purposes of the processing are erased or rectified without undue delay (\"accuracy\");<\/p><p class=\"whitespace-normal break-words\">(e) be kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed; personal data may be kept for longer periods only if the personal data will be processed for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes in accordance with Article 89(1), subject to the implementation of appropriate technical and organisational measures as provided for in this Regulation to safeguard the rights and freedoms of data subjects ('limited storage');<\/p><p class=\"whitespace-normal break-words\">(f) be carried out in such a way as to ensure adequate security of personal data, including protection against unauthorised or unlawful processing, accidental loss, destruction or damage (\"integrity and confidentiality\"), by implementing appropriate technical or organisational measures.<\/p><h5 class=\"text-lg font-bold text-text-100 mt-1 -mb-1.5\">(2) The controller is responsible for compliance with paragraph (1) and must be able to demonstrate such compliance (\"accountability\").<\/h5><h5 class=\"text-xl font-bold text-text-100 mt-1 -mb-0.5\">Information to be
